TERMS AND CONDITIONS OF SALE

  1. Upon payment towards any portion of an order, the Buyer is subject to the following Terms and Conditions of Sale, irrespective of any contrary provisions in the purchase order or ANY other documentation.

  2. All taxes and other governmental charges upon the production, sale, shipment, or use of the product shall be paid by Buyer.

  3. All shipping and associated costs will be the responsibility of the Buyer. Shipping is FOB from Virginia with title and risk of loss passing to the Buyer upon delivery of product to the common carrier. SHOULD AN ORDER BE SHIPPED, The buyer will be provided with a tracking number from a recognized carrier for all purchased products. Buyer shall have the right to purchase additional insurance, solely at the buyer’s expense, prior to being shipped.

  4. Buyer’s payment of a deposit, constituting a down payment in consideration of a purchase order, is non-refundable unless Apollo Arms, at is sole discretion, refunds said deposit.  The Buyer agrees that Apollo Arms shall have the sole discretion to refund any deposit for any reason at an at-will basis. Should any deposit be refunded by Apollo Arms, the purchase agreement shall be terminated, nullifying all responsibilities and liabilities of all parties.  Apollo Arms shall apply any refund towards the original payment method or in the form of a check.

  5. All orders shall not be canceled or modified, either in whole or in part, without the prior consent of Apollo Arms. 

  6. Use of all products is at the Buyer’s sole risk.  Apollo Arms disclaims all express or implied warranties including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
